Aggie Bonfire is great. The burning desire, the blisters, the friendships. Post here if you feel the same way. No hijackers please.

Keep it going, guys and gals.

Stay safe, soundly engineered, and eschew the horseplay, hazing, and alcohol--as you have done so well since the traditon moved off campus.

Remember that everything you do well will be silently appreciated but anything you do wrong will be loudly condemned.

Thanks for working so hard and keeping the tradition alive.

Maybe when my last child arrives in the Class of 2024 there will still be a Bonfire for her to build and her parents to watch burn. Thanks again, ever so much.

I just got to wondering...

how long can Texas A&M leave a trademarked name unused before it becomes available again?

To go along with this...does anybody know of any way that the university has used the term "Aggie Bonfire" in the last 7 years?

From Wikipedia, on trademark abandonment:

quote:
Trademarks rights must be maintained through actual use of the trademark. These rights will diminish over time if a mark is not actively used. In the case of a trademark registration, failure to actively use the mark, or to enforce the registration in the event of infringement, may also expose the registration itself to removal from the register after a certain period of time.

All jurisdictions with a mature trademark registration system provide a mechanism for removal in the event of such non use, which is usually a period of either three or five years. The intention to use a trademark can be proven by a wide range of acts as shown in the Wooly Bull and Ashton v Harlee cases.

In the U.S., failure to use a trademark for this period of time, aside from the corresponding impact on product quality, will result in abandonment of the mark, whereby any party may use the mark. An abandoned mark is not irrevocably in the public domain, but may instead be re-registered by any party which has re-established exclusive and active use, and must be associated or linked with the original mark owner. Further, if a court rules that a trademark has become "generic" through common use (such that the mark no longer performs the essential trademark function and the average consumer no longer considers that exclusive rights attach to it), the corresponding registration may also be ruled invalid.

While A&M may have not used the 'Aggie Bonfire' trademark for commercial use in some time, litigating abandonment of the trademark would be tricky, I imagine.

It's not really "Aggie Bonfire" that would be the problem. A&M fights anything that uses "Aggie." I been down that road with them. So, basically even if they abandon "Aggie Bonfire" we'd still have to fight over using "Aggie"

How about Agriculturalist Bonfire?

Aggieland Bonfire would be the best non-infringing choice.

Of course, A&M could launch a "likelihood of confusion" challenge against that moniker.

Unity Project. Unified Projects Group. Aggie Student Bonfire. Student Bonfire. Bonfire. Aggie Bonfire. Fightin' Texas Aggie Bonfire.

A rose by any other name would still smell (and burn) just as sweet(ly).

Great job, men and women. You built one hell of a fire and did an amazing job. Keep up the spirit, the good work, and our tradition. See you at first cut.

All,

Please continue the tradition, many of us have little Ags (mine are 5, 3, 2) and I pray one day they all will get to experience Bonfire and a tradition like no other.

Keep it going. It was the best experience at A&M. I hope to have my children and grandchildren have the opportunity to experience it. God Bless Bonfire!
