This is an underrated and very good comment. While the prosecution may not do much more than articulate it while he's on the stand by asking a question or two, they certainly WILL make a substantial reference to it in closing. I have to believe Shook, as a former prosecutor, knows this and spent most of the weekend counseling the client and family to not take the stand and to take a plea deal.

Prosecution's closing statement in regard to this: "The difference between today and April of last year when Mr. Anthony stabbed a student to death was, today he doesn't have a knife or other weapon in his hand and isn't trying to intimidate you; he's trying to beg you to excuse his murderous behavior. Don't fall for this."

EDIT: if Shook/other defense attorneys think this strategy will get him less time, they may do it and take the risk.

Such a strange thing that this is a high profile trial. High profile crime, to be sure, but it is about the most cut-and-dried murder I've ever read about.

I don't know what exactly is going on, of course, but I can't see the prosecution making any plea offers once the trial started other than perhaps a last ditch effort to avoid trial (i.e. original plea deal 50, has to serve half; last ditch still 50 but eligible for parole in 20, or something of that nature). I was speaking here assuming the offer is from the defense.

What would the prosecution accept? I have no idea what their thinking is on that. Based on what I'm hearing about the evidence, I think a hung jury is very unlikely. The only variable now is what the jury is willing to sentence him to.

I could see 25 years. 20 years before being eligible for parole. The Metcalf family seems like the type to not want to destroy Anthony's life if it can be somewhat avoided while still getting justice.

I don't think this is a last minute plea deal. Wouldn't take this long. My gut tells me defense is getting ready to rest and they are hammering out the final jury instructions so when the jury does come back today, they can keep moving fast.

But that is still a guess.
