I would think the issue of whether or not MK broke military law would be determined by a military court? Is he going through Fed court because that is an appropriate way to address his grievance or is it that it doesn't matter what the Fed judge says ……it will al be determine in a military court?

I'm certainly no expert but the USMJ applies to retirees, however, once all the appeals have been exhausted the verdict can be appealed to the Supreme Court.

So someone smarter than me will have to explain how MK going federal immediately helps him.

I know nothing about the legalities of this but he's completely worthless as a senator.

He's playing a PR game in the court of public opinion. He's hoping good polling will get them to back off going after a sitting senator.
