I have a friend that is 82 yr old white guy. He was in L' Auberge casino a couple months ago and was escorted out of the casino for some type of inappropriate comment. This friend vehemently denies saying or doing anything. He was not shown any evidence and was basically humiliated in the casino. He has been a long time customer of theirs with no issues at all. He wrote a letter and sent it to several people but did not hear back. He is pretty pissed about the whole deal and now wants to talk to a lawyer about how he was treated. Does anyone have a recommendation?

Is he banned from the casino?

Did the casino commit crimes by escorting him out?

He is of an older generation that had a sense of pride and he feels he was wronged. Not sure if he is permanently banned, but he was basically marched thru the casino and banned that night. Easiest thing is to let it go, but he has a strong sense of right and wrong and fells he was wronged. Obviously if he was a minority or woman he would have 50 law firms lined up to help him hit the lottery.

I never understood the term 'reverse discrimination' or 'reverse racism'.

So was the discrimination the cause of his ejection, or is it somehow discrimination because if he were black he would have already sued?

Was the incident paired with breaking casinos' cardinal rule of one cannot win too many times... raking in more $s then paying in to play?

you really just need to explain to him that he can just find another casino to transfer whatever he gets via loyalty benefits and dump money there or dump money on a lawyer for the same result (nothing).

Once he remembers the dirty joke he told please post it here so we can all re-use it.

You will be doing him a great service by persuading him to let it go. Most of us have faced our relatively minor injustice. It's possible that whoever he dealt with was just having a bad day. If he like that casino, he can walk in and see if they say anything. My guess is that no one will notice.

Sorry OP, regardless of his pride, they are giving you solid advice. Unless he just wants to line a lawyer's pocket (assuming you could find one to take the case) this isn't going anywhere. Even if he was a minority, they can kick you out for virtually any reason. No decent attorney is going to mess with a losing proposition.

Take his business elsewhere is the only answer.

Can't imagine the number of witnesses that would have to be found and lined up for depositions…if they were ever found since they'd have to be guests, not employees. And then, take your one lawyer and try to outlast the fees you'd incur vs a casino's law firm on retainer. Yikes, Go be pissed and keep whatever money you were about to lose that night, and never return.

As long as it is not discrimination for a protected class, isn't discrimination legal? I doubt that they can discriminate on account of race or age or sex, but I think that discrimination on account of many other things are likely permitted.

What was he doing when they escorted him out? If he was playing blackjack, maybe they thought he was card counting.

If the comment was considered racist or sexist of some kind, he's screwed. He'll just be looked at as an old racist white dude.

Just play it out in the media and hope some right wing people pick it up and make a story out of it. That's the best he can do.

Tell him to move on with his life. At 82, he doesn't have a ton of it left.

It's an academic veneer used when an institution wants to discriminate against whites. It's a kinder, gentler racism that implies it's ok cuz whites discriminate against everyone else.
