I used juvenile crimes the defendant had been "convicted" of in punishment a couple of times. Never tried to prove up an offense as a juvenile that defendant was not convicted of. Don't think I ever had an appeal on the issue of using juvenile "convictions" in the punishment phase.

Thanks for the clarification. I interned with a juvie prosecuting attorney for a summer when I was at A&M and way back then, juvie records were sealed unless violent crimes. MIP or shoplifting would be sealed after reaching majority age.

Prosecutors can still use them for punishment evidence, to enhance felonies is some cases, etc

His coach testified that he was to compete that day. On cross he admitted that Anthony was scheduled to compete early and should have been warming up for that. Weather was getting iffy though. Not raining heavily yet but drizzly I guess.

The actual state of the weather was unclear over a number of witnesses. Did the rain start after the encounter? Before? During? One thing is clear, Anthony had no trouble running out into the weather after he stabbed Metcalf.
