I guess my question was, if they didn't technically fire him, why are they offering to settle with someone who is still and employee?

its the timing of the termination that is the issue, not whether he was terminated. no one thinks he is still the coach

But they were offering to settle shortly after that Sunday, not before the the claim that Woodward did not have authority to fire him.

Correct. Why would you make multiple settlement offers to someone you hadn't fired yet?

i think you are misunderstanding the issue.

(based on the lawsuit filed by kelly, what happened was) LSU decides to terminate kelly and he is told he is fired, formal notice will come. they then try to work a deal.

its not unusual to try to work out a deal when you owe someone money. especially that much

"Formal" notice wasn't made until this past Monday, correct? The settlement offers had come sometime in the previous two weeks. I would think that if lsu representatives had relieved him of his duties (the day after we beat them) and he was receiving settlement offers, then he could reasonably consider himself to be terminated and I think any reasonable person would think the same. lsu can claim that he was fired any time they like, but nobody else is going to see it that way is all I'm sayin...

He's not. Sucker bets like this are how Vegas can afford to build all of those casinos.

My favorite theory so far is that

  • BK was not fired via a written letter or statement so it was not official at the initial meeting.
  • After the A&M game they had a by week in which BK went on a vacation to Florida
  • He went on vacation without seeking permission and should have been planning for the Alabama game
  • His absence constituted a failure to perform his duties as head football coach
  • Therefore he is now formally fired with cause.

Couple of posts above mentioned fired AD Woodward. He also had a buyout, did he not? $6.5 million according to google. Any word on if lsu is going to honor the terms of his buyout? Tin foil hat has me thinking that they try to tie his buyout with the same BS unless he admits in court that he didn't have the authority to fire BK in an effort to make lsu's claims seem somewhat plausible. Thoughts?

I would guess that Woodward would like to continue to work in University Athletics. So far, this isn't on him. This is LSU's mess that was completely created by the governor and/or other BMTs. If, in order to protect LSU and throw BK under the bus, Woodward was to agree to admit under oath that he knowingly let BK go without authorization, Woodward would subsequently be toxic to any prospective university AND any potential coach he would be interested in hiring in the future.

I would guess that Woodward's prospects through the remainder of his career well exceed the $6.5M he might be shorted by not playing LSU's game.

If this scenario were to be attempted by LSU, I wouldn't be surprised to see Woodward wind up as a witness FOR Brian Kelly...

Throw into this imbroglio that this will all be litigated under Napoleonic law. Under the principle of Redhibition a "buyer" may sue if a "product" has a non-apparent defect that the seller knew about;
someone might end up with a trip to the guillotine!

BK's counsel could easily argue "apparent authority" even if Woodward didn't have "actual authority", along with a lot of other quotes from across that administration all the way up to the governor, and easily win this case.

Such a bad look for a once-heralded enterprise. What would be head coach would want to walk into that snakepit?

Court and judge are in the state of Louisiana. Don't ever count on easily winning any case there in the swamp. That place is rife with corruption.

Somebody needs to make a phone call and suggest to the man in Louisiana that they need to stop the sleaze and arrange for LSU to honor the coach's contract or risk certain expulsion from the SEC.

His contract states that if they were firing him for cause that they had to inform him of this within 7 days of termination (it has been 16 days now).

They are trying to back track and say that he wasn't officially terminated until yesterday because Woodward didn't have the authority to fire him without the approval of the board (which has now approved it supposedly).

They informed BK yesterday that he is being fired for cause. We don't know yet what the accusation is, but sounds like it might have something to do with how he handled the Greg Brooks situation (a player that was diagnosed with cancer in 2023)

This is going to get ugly. Love it.

Yeah, the problem is the BOS acknowledged the firing and their knowledge of it in their 8am public meeting a week ago. They can't refire him for cause.
