Huge facility just south of Laredo called Camp Walker has been dismantled as well, up to Inauguration Day, there were unmarked white buses all with NJ license plates in a line ready to load and head north. The buses stopped the day Trump took office and camp torn down shortly after that. It is now housing a staging area with stacks of border wall and equipment to handle it.

The stacks of panels don't seem to be disappearing to the wall fast enough for me.

So of course, if they provide fraudulent SSN etc, that is not on the company. But if they are knowingly employing illegals, there needs to be a steep penalty for companies that employ known illegals.

Construction companies that default on contracts with the federal government because they hired a workforce and calculated their winning bid price based on illegal labor should face prosecution under the False Claims Act.

Ok.

A construction company can follow all laws in its hiring practices and still have illegals working for them. They can make sure to hire reputable vendors / subs who also follow laws in their hiring practices yet still have illegals working for them. So you want to prosecute a company for competing in our economy while following all laws?

Some of you like to respond out of anger and emotion. Why don't you lobby for e-verify requirements for every employer or something that can better empower employers without punishing them by having them institute more rigorous controls than required?

Why? Because many employers are providing "undead" social security numbers to illegal aliens to subvert eVerify. Those ~60 million SSN of ancient people was a pool from which employment fraud was being committed. That's why the Social Security Administration didn't want to fix the problem. It's still up to the prosecutor to make the case that the employers knew or should have been reasonably expected to know that they were employing illegals.

That is a different accusation. And I'm sure there are some that do it, but the ones providing them with ssns and fake ids are separate than the business employing them. More than likely it is a third party criminal organization that is providing the forgeries. And I agree that those should be shut down. Obviously if the business is the one doing that they should be shut down, but that is a whole other criminal charge that what you initially suggested.

SOME construction companies intentionally hire (or use middlemen to run) illegals. They do so to reduce expenses. They can then underbid honest companies (both clean and the unclean who at least make honest attempts at excluding illegals from their jobs).

I have zero compunctions against raining severe penalties upon a business who intentionally hires or intentional blind-eyes the hiring of illegals. They've been warned numerous times.

They know, just like the mom and pop resturants know, does not matter what SSN they provide. THEY KNOW. because only illegals would work for what they work for.

I have seen the books, and trust me, I dont think those same resturants could survive if they had to pay Americans.

The demonization has turned so far on this topic that I'm obviously not going to win over anyone. But I think you're very naive to think you can start prosecuting people because "they know" when someone provides them with documents that follow the letter of the law.

I agree with the general sentiment that this problem needs fixed. I feel like the simplest solution is to require e-verify or something equivalent. But to not have that level of verification and assume all business should comply because "they know"ā€¦I'm not even sure what to say to that because it's so far off of the rails of conventional law and order.

I think if they can demonstrate reasonable care, they should get off lightly. But there are companies that knowingly employee numerous illegals to undercut legitimate competition. Illegal labor has killed skilled craftsmanship at the lower end of construction projects.
The best way to keep evil men from wielding great power is to not create great power in the first place.

In this episode RPA tells the story of a guy who owned a wildly successful roofing company in the Hamptons. He paid good wages, obeyed OSHA, paid his taxes, and did high quality work. In the space of a few months, out of state roofing companies came in with crews of illegal aliens and were quoting prices 50% less than he could do it. The illegal alien construction workers were bidding up residential rental rates because they were splitting the rent by 10 or more men living in one single family dwelling. The local city counsel even catered to the illegal labor market by setting up a drive through loop at the local Home Depot where the illegals would hang out and wait to be hired by contractors looking for cheap day labor that they would pay off the books.

Unethical contractors ruin the market for those that follow the rules.
