FWIW, this (from the case below) is a run-of-the-mill asylum claim in the modern era. None of it qualifies.
— Gene Hamilton (@GeneHamiltonUSA) September 3, 2025
Asylum is for persecution on account of:
- race
- religion
- nationality
- political opinion
- membership in a particular social group

Many in the “defensive”immigration bar engage in conduct that would subject attorneys in other contexts to sanctions under Rule 11. Others exploit their clients. Others file meritless/fraudulent claims.
— Gene Hamilton (@GeneHamiltonUSA) September 3, 2025
And they got away with it.
That must end. And soon.
Real sanctions.
This is a critical step in the right direction. Hopefully, there will be more soon.

In the meantime, kudos to @AGPamBondi and her team for taking this step to restore integrity to our system.
Exactly. Or withholding of removal, but same deal.

Abrego Garcia’s claim was and is complete and total legal garbage. Not cognizable.
oh no said:
why wasn't changing the definition of asylum and changing how asylum claims were handled in order to let in 20 million migrants unfettered CRIMES? Being poor and wanting free stuff has never been a valid claim for asylum seekers. Almost of zero of the 20 million unvetted mass migrants were fleeing political persecution or war torn lands. Mayorkas, Biden, and their globalist handlers and overlords should be in prison.

Outstanding. Of course, there should be no article III judicial review of this action, but we will have to wait and see.

"It's horrific," said Marks, a former head of the immigration judges' union. "No self-respecting lawyer could look themselves in the mirror and take these positions. … It's a total cynical move to try to force people to litigate their cases while they're detained."

That's right...
No one else in the US has ever had to litigate their cases while detained...
