I've served on multiple Collin juries, as recently as January when I was a foreman for one. They'll convict. Just not sure they max out the "kid" as much as I hope.

I think the defense lost on the jury selection. If the one person didnt say "I couldn't put a brother behind bars" and got on the jury it would be different. Props for honesty I guess

In a self-defense case a lot rides on what the defendant was thinking and perceiving in the moment. This isn't a situation where there was some sort of obvious fear of death or significant body injury that the jury would be able to surmise on their own.

Very difficult to make an argument along those lines in this particular circumstance unless the defendant testifies.

"Provocation" is not really an issue here. It only comes into play where there has been a legitimate self-defense. If you punch someone in the face for no reason, then they pull a knife, if you then pull knife and stab them, your claim of self-defense likely goes away because you provoked the incident. Do you have a right to deadly force self-defense if someone pulled a knife on you. After that is established, you look back to what happened beforehand.

Here, there was no legitimate claim of self-defense. Karmelo murdered him.

Yeah, looks like they are trying to wrap it up today. That seems really fast.

Oh they'll have to try to call some character witnesses for Anthony, at least.

That could open the door to other viiolent encounters the defendant may have had. Impossible to know without being in the middle of the trial.

Regarding Jury and jury selection...
Wasn't it mentioned earlier in this thread that they had a 200+ person jury pool and excused in excess of 100 potential jurors?

Did the attorney's get extra strikes? It's my understanding that the judge can typically strike as many as he or she deems fit for any reason?

Not a lot of jury experience. Only had jury duty that I had to respond to 3x. A couple when i was still in school and once the notice arrived within a week or so of moving out of that county (and I already had a new TxDL with new address). In two of those no juries were empaneled (one both trials were postponed and new summons were sent), one was civil and settlements were reached. The third was a pool for two cases, one postponed and the other... Well I was juror # 194 of 200 and I personally knew and had working relationship with 2 of the states witnesses.

I imagine that hords of potential jurors had already formed an opinion on the guilt/innocence of the defendant because of all the pre-trial publicity. Some may have known or known of either the victim or defendant because of having kids in school with them.

Some people are squirrely and cannot judge other people. So they too get excused early.

But so much pre-trial publicity was certainly a problem in getting a jury.

OJ was found not guilty in under 4 hours, I think the verdict on this dude will break that record.

I may be naive but I believe everyone wants to put this case behind them and no one wants this coward walking the streets ever again.

killer that uses a knife on an unsuspecting stranger is as about as evil as it gets.

Yes they had a large panel on Monday. Six hundred were summoned, never heard how many actually showed up. Monday was spent with those potential jurors filling out a lengthy court approved questionnaire. Tuesday both counsel and the judge reviewed the questionnaires. Then notices were sent to the ones remaining on the list to return on Wednesday for formal voir dire.

It was a long slog on Wednesday appearing they would not complete jury and alternate selection that day but damned if Judge Roach didn't pull it off in the end. Have to give him kudos for that.

Thanks... Been traveling for work so getting to follow is in fits and spurts...
I recall catching posts towards the end of selection on Wednesday. I didn't care to dig back but just sitting here thinking when more jury commentary keeps coming up, "wasn't a lot of this discussed during selection coverage?"

Calling it "coverage" is a bit of a stretch with this court's rules in place.

If they don't already exist, I could see community service groups teaching citizens how to avoid disqualifying themselves. The "get the vote out" organizers will transition to "protect our own" jury duty advocates.

That wasn't honesty. That was "I don't want to serve and I know a quick way to get struck."

Yeah, that was a no win situation for jury members. Whichever way it came out, some people were going to be pissed off and possibly harassing them.

That sounds like a dangerous tip-toe with perjury. Aren't you sworn to tell the truth during voir dire?

Those three were peremptory strikes. They did not say anything to get struck for cause like the person that had "trouble putting a brother in jail."

The state has now rested its case against Karmelo Anthony. We had heard rumors that Hunter Metcalf might be testifying today, but the state is now done calling witnesses. Then the judge asked Karmelo's defense team what was next.
Defense asked for the court to move to a direct verdict. That's a motion is asking a judge to rule in their favor before a case is submitted to the jury, arguing that the opposing side has legally failed to present enough evidence to prove their claim
Judge said no.
Then the judge asked the defense what's next. They said they didn't know and we are now taking a break.

Geologist, not legal eagle here...
Does that mean the Defense tried, with a straight face, to say the prosecution failed to show evidence that aligned with the charges brought???

Seriously?! A direct verdict after those testimonies? WTF is the defense smoking?!

The defense has no ****ing case and asked for a recess after they don't the judge they didn't know!! This is atrocious and being setup for ineffective counsel!

By the state. Those jurors were educators in FISD from what I gather. So their proximity to the case was the reason they were struck, as opposed to their being black.

Routine procedural motion to preserve the record for possible appeal. They have to make that motion regardless of merit.

They know exactly what they want to do. They want to keep their client off the witness stand. So one last time they are talking him out of testifying.

When court resumes the judge will ask defendant if he wishes to waive his 5th Amendment right and testify. If he says "yes" then it is against his lawyers advice. But that happens fairly often. Especially with young black clients.
If he does testify that rarely works out well for him.

If client is thinking of testifying judge may give him until Monday to decide. In reality he is giving defense attorneys time to do their job.

I believe this is already happening. Not in this trial, but I think this is part of the "restorative justice" movement.
