They can't put him on the stand because the prosecution will ask him why he was there in the tent in the first place. It will ultimately come out, either in his testimony or in rebuttal testimony, that he was there to jack things left by the track participants when they weren't looking.
The rain is his cover story. The other punkass behavior in his history will be more problematic
It is my understanding, correct me if wrong, that one or more of the locker rooms were open. Also, under the stadium was available. Far safer than any tent in any spring Texas weather involving rain.

He can articulate a "cover" story but it won't hold up. Also there were other tents.
