About an hour after the flights departed Texas--one headed for El Salvador and one for Honduras and likely unaware of the proceedings in DC--Boasberg told DOJ, "you shall inform your clients of this immediately, and that any plane containing these folks that is going to take off or is in the air needs to be returned to the United States but those people need to be returned to the United States. However that's accomplished, whether turning around a plane or not embarking anyone on the plane or those people covered by this on the plane, I leave to you. But this is something that you need to make sure is complied with immediately. "

Boasberg did not enter his written order until 7:25pm (flights were well out of US airspace by then), about 40 minutes after he made that statement. DOJ argues that a written order, not a verbal command in a hearing, is required. Boasberg disputed that in today's hearing and further claimed his authority does not end at the "water's edge."

Another flight took off after Boasberg's written ruling but DOJ says that plane did not contain illegals covered under Alien Enemies Act.

Boasberg still has not elucidated any illegalities related to the Alien Enemies Act or explained the basis for his energetic defense of the illegals. This is all a major power play and a contempt trap.

They were not required to comply with his verbal "order." That was settled in a 2003 case involving the W EPA.

Boasberg is a black-robed tyrant who doesn't know the law. I wonder how many assets the radical leftists are devoting to helping him do this.

Not quite that, but close!

An oral directive is not enforceable as an injunction. That is what the case you cite stands for and what Team Trump has correctly argued.

Yeah, I was just listening to Levin talk about it yesterday. He and Landmark Legal were involved in that litigation. He was pleasantly surprised to learn the government cited it.

IANAL, but I work with plenty of them and grew up in the house with one.

And an injunction is much more serious than a TRO.

Boasberg is really in pretty hot water here, imho.

He can be as pissed as he wants, but he's going to wind up losing/backing down one way (appeals/jurisdiction/justiciable matter hearing/findings) or the other (disqualified).

He's in over his head, period.

We need to demand that Congress dismantles some district courts. These were not created in the Constitution, they were created by Congress.
