In hilarious move, Trump files preliminary motion to set aside last minute 5-year Biden collective bargaining deals with federal unions, a few minutes after signing the EO, in…Waco, TX.

What makes this case so interesting is that the suit was filed on behalf of the Departments of Defense, Agriculture, Homeland Security, Housing and Urban Development, Justice, Veterans Affairs, the Environmental Protection Agency, and the Social Security Administration in the single-judge Waco Division of the Western District of Texas. It was also filed minutes after President Trump issued his union-busting executive order.

What's interesting is that the district court thinks it has nationwide jurisdiction, while the appeals court rightly knows their jurisdiction has been strictly defined and their rulings only apply there.

Which is why this other case wasn't thrown out - the DC Circuit stay didn't apply in Seattle.

Apparently, district court judges are now the most powerful people in the country...

Procedurally, a TRO expires by its own terms. In that respect, not considered a final order from which an appeal can occur.

But I share your frustration with the loosey goosely manner of which court has jurisdiction and which do not. Maddening. A very tiny fig leaf for what is essentially judicial obstruction.

I would love to see them make TROs only available to plaintiffs who are before the court. If they want a nationwide injunction, they either need to get a class action certified so they can speak for a larger group or go ahead and go through full hearing to adjudicate a PI.

They are currently only applicable to the parties before them. And certifying a class action also is supposed to follow a set procedure.

None of the federal rules of civil procedures are being adhered to by these courts. Why I term it as judicial obstruction. Under the rules, courts can delay all they want from issuing a decision and opinion after a hearing/trial. (Witness Judge Totenberg issuing her ridiculous ruling from a 17 day trial before in January OF LAST YEAR!)

But what is happening now is a vast contortion of the laws that are binding upon them. Nor do they GAS.
