I honestly don't know. BUT the general rule is that of two statutes, the narrower one will control. When it comes to class certification, the narrower one would be Rule 23 than the Writs Act.

Yes there are other statutes that can be used.

The advantage of using AEA is the absence of justiciable issues other than habeas and that is a very truncated proceeding. Speeds things up a lot, IMO.

If that basis is a car loaded with brown people, then I do have a problem with that.

Have some prescribed method and stick to it. Could be:
  • Vehicles at or exceeding capacity for passengers
  • Vehicles with foreign plates
  • Vehicles that appear to be manufactured before 1990
  • Vehicles that are adorned with foreign flags
  • Every forth vehicle
  • Vehicles where drivers disobey any traffic law

Got to have some rational. Can't be random.

There's a about 27 federal prisons in Texas with about 15,000 total capacity that can be cleared out for illegal aliens to be detained until this gets resolved.

Trump could pardon everyone not suspected to be cartel members in there with drug offenses of a certain degree to clear space, and ship the rest to another prison in another state.

If a habeas case has to be brought in the District where the person is located, then there is no way to do a nationwide class!
