And that's the problem. Normally a defendant would fight that to get a dismissal with prejudice. No sane defendant would be ok with this.
If the sane defendant knew that the original prosecution was politically based, that the perp responsible for that is now crapping his diaper in a luxury home safely away from the levers of power, and that the statute of limitation for the crime will run out before the people who lined up the original prosecution have the chance to come back into power; it may be a completely rational decision to be ok with it.

Many of these federal trial courts are in DC. Don't they talk with each other? Like ever? Back in my day, judges in the same courthouse, talked with each other, in consultation on cases they had in common.

I'd prefer to save the treason calls for actual cases that warrant it (like Milley's deals with the Chinese). It cheapens the accusation if everybody disagreeing with Trump is called treasonous. This guy can be wrong and possibly corrupt in applying his judgements without it rising to the level of actual treason.
